Welcome to Cupidify. By accessing or using our website at cupidify.app and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Cookie Policy, and Refund Policy.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

Cupidify is a digital marketplace that provides customizable digital templates for special occasions such as anniversaries, birthdays, romantic events, and more. Users can purchase time-limited access ("rentals") to personalized digital experiences that can be shared via unique links.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms.

4. Purchases and Payments

4.1 Pricing and Payment

• All prices are displayed in Thai Baht (THB) unless otherwise specified
• Prices are subject to change without notice
• Payment must be made at the time of purchase through our approved payment methods
• You are responsible for any taxes applicable to your purchase

4.2 Rental Access

• Template rentals provide time-limited access as specified at the time of purchase
• Access begins on your selected start date and ends automatically at the specified expiration time
• Once the rental period expires, your personalized template will no longer be accessible via the shared link
• We are not responsible for any inability to access the Service during the rental period due to factors beyond our control

4.3 Promotional Codes

Promotional codes are subject to their specific terms and conditions. We reserve the right to modify or cancel promotional offers at any time without notice.

5. User Content

5.1 Your Content

You retain ownership of the content you upload to the Service (photos, text, etc.). However, by uploading content, you grant Cupidify a worldwide, non-exclusive, royalty-free license to:

• Use, store, display, and reproduce your content to provide the Service
• Create derivative works (such as generating your personalized template)
• Use anonymized or aggregated data for analytics and service improvement
• Use your content for marketing and promotional purposes (with appropriate anonymization where applicable)

5.2 Content Restrictions

You agree not to upload, post, or transmit any content that:

• Infringes on intellectual property rights of others
• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Contains sexually explicit material, nudity, or pornography
• Promotes violence, discrimination, or illegal activities
• Contains malware, viruses, or other harmful code
• Violates the privacy or publicity rights of others

We reserve the right to remove any content that violates these Terms without notice or refund.

6. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Cupidify and are protected by international copyright, trademark, and other intellectual property laws. Our templates, designs, code, graphics, and branding are proprietary and may not be copied, modified, or distributed without our express written permission.

You agree not to:

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any defects in the Service will be corrected

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUPIDIFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or use of our servers
• Damages resulting from any interruption or cessation of the Service

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Cupidify and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at cupidifym@gmail.com to attempt to resolve the issue informally. We will attempt to resolve your concern within 30 days.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

11.3 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Thailand.

11.4 Waiver of Class Actions

You agree to resolve any disputes on an individual basis only, and waive any right to participate in class action lawsuits or class-wide arbitration.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment or payment disputes
• At our sole discretion for any other reason

Upon termination, your right to use the Service will immediately cease. All provisions that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Cupidify regarding your use of the Service and supersede all prior agreements and understandings.
